Applicable document: any booking placed through the inchirieriutilaje.ro platform implies full acceptance of these Rental Terms.
§1. Definitions
Lessor – CORINA PLAST SRL, owner of the machines.
Renter / Client – the natural or legal person booking the machine through the platform.
Machine – the excavator, bulldozer or equipment listed in the order.
Rental with operator – the machine together with a qualified operator employed by the Lessor. All machines are rented exclusively in this arrangement.
Rental period – the interval between the start and end dates registered in the booking.
§2. Object of the contract
By acceptance of the booking confirmed by the Lessor, the Renter receives the temporary right of use of the machine, exclusively for activities compatible with its technical specifications. The machine remains the property of the Lessor for the entire duration of the contract.
§3. Period and rate calculation
Rates shown on the website exclude VAT and include the operator. The units are:
- Daily rate – the machine with operator, 8 hours of effective work, Monday–Saturday;
- Per m³ – based on the volume of material handled, declared at booking and verified at the end of the job.
The minimum rental period is 10 days. Mandatory insurance (RON 40/day) and the hand-over inspection (RON 150, once per order) are invoiced in addition to the rent. Overtime beyond the daily norm and work on non-working days are invoiced separately, at the rates applicable at the time of the job.
The rental period starts when the machine leaves the Lessor's depot and ends upon its return in proper working and cleanliness condition.
§4. Handover and return
The Renter must provide: an adequate and safe loading/unloading area; a practicable access road for the trailer; the permits and approvals required for the works (building permit, oversize approvals, escort etc., as applicable); a representative present to sign the handover report. Return takes place as scheduled at booking confirmation. For extensions, the Renter must notify the Lessor in writing at least 24 hours in advance; the Lessor may refuse if the machine is already booked by another client.
§5. Transport, fuel and consumables
Transport to and from the job site can be:
- provided by the Lessor – RON 1,500 for the first 75 km round trip, then RON 9.5 for each extra km, excluding VAT; the distance is estimated by road from our base in Alba Iulia and the amount is shown in the booking before payment. For delivery, the machine's unavailability during transport is added as shown in the booking;
- provided by the Renter – free of charge, at their full responsibility, with an adequate trailer.
Fuel and lubricants are not included: the machine is handed over with a full tank and must be returned full. Differences are invoiced at the price of the nearest fuel station plus a 15% administrative fee.
§6. Renter's obligations
Throughout the rental, the Renter undertakes to: use the machine only for its intended purpose, as per the operating manual; use it with due care; not sublet, lend or assign it to third parties without the Lessor's written consent; not use it at locations other than those declared without prior notice; immediately notify the Lessor of any damage, accident or theft; return the machine in the condition received, properly cleaned, normal wear excepted. Damage beyond normal wear is invoiced based on a technical report issued by the Lessor.
§7. Deposit
The Lessor may request a refundable deposit, paid by bank transfer or card before handover. The deposit is refunded in full within 5 working days of the machine being returned in proper condition. In case of damage, the estimated repair value is withheld, with the balance settled based on the final invoice.
§8. Insurance
The machines are insured by the Lessor for the usual risks (trailer RCA, CASCO where applicable). The Renter remains liable for: the insurance deductible, within the limit communicated at booking; damage resulting from negligent use, use contrary to the manual, or under conditions excluding the insurer's indemnity (alcohol, missing licence, technical modifications etc.); theft, if reasonable guarding measures were not taken.
§9. Payment and invoicing
After the booking is confirmed, the Lessor issues a pro forma invoice with the rental total: rent with operator, services, transport and the refundable deposit. Payment is made in full, in advance, by bank transfer, before the machine is handed over; the pro forma is valid for 5 days.
The final invoice is issued on return, based on the actual days. Overtime, missing fuel or any damage are settled on the final invoice, payable within 7 calendar days. Late payments incur penalties of 0.1% per day, capped at the invoice value. The deposit is refunded within 5 working days after the machine is returned in proper condition.
§10. Cancellation and changes
The Renter may cancel:
- free of charge – at least 24 hours before the scheduled start; amounts paid are refunded in full;
- with one day of rent withheld – under 24 hours before the start or in case of no-show; the rest is refunded.
Refunds are made within 14 days at most. Cancellation is done from the client account ("My bookings") or by email at office@inchirieriutilaje.ro. The Lessor may cancel in case of technical impossibility, with at least 24 hours' notice and a full refund.
§11. Termination
The Lessor may terminate unilaterally, without notice or compensation, in case of: unpaid invoices more than 10 days overdue; use for undeclared purposes; refusal to allow inspection of the machine; repeated breach of obligations. In such cases the machine may be recovered immediately at the Renter's expense.
§12. Force majeure
The parties are exempt from liability for non-performance caused by force majeure events (natural disasters, armed conflicts, government restrictions, pandemics etc.). The affected party shall notify the other in writing within 5 days.
§13. Personal data
The Lessor processes the Renter's data in accordance with the Privacy Policy and Regulation (EU) 2016/679 (GDPR), exclusively for contract performance, invoicing and booking-related communication.
§14. Disputes and governing law
These Terms are governed by Romanian law. Disputes are settled amicably; failing that, the courts at the Lessor's registered office have jurisdiction. Consumers may also use alternative dispute resolution through ANPC, free of charge, by filing a complaint at reclamatiisal.anpc.ro.
§15. Changes to the Terms
The Lessor may update these Terms. The version in force at booking confirmation governs the contract; later changes do not apply to already-confirmed bookings.
